Motorcycle accidents differ substantially from other motor vehicle accidents. Common sense tells us that motorcyclists simply lack the protection that’s available to other motorists. Protective clothing and helmets may assist in reducing injuries, but all of us who ride know that such protective outerwear will probably not prevent us from being more seriously injured in case of accident.
I’ve been an avid motorcycle enthusiast for over 35 years and continue to love the experience of riding. My wife and I tour on our bikes and are not just posers out for the parade. I’ve experienced a couple of motorcycle accidents and have avoided many more. My years of riding, combined with my personal injury/accident legal experience, have underscored to me that too many motorists simply don’t see us. We can run our high beams or our driving lights but that left-turning driver will still cut us off. To add insult to injury, the media and general public automatically assume the motorcyclist must have been at fault. I’ve learned that “eye-witness” testimony is often questionable. Witnesses often overestimate the motorcyclist’s speed just prior to the accident. Einfeld Law retains the services of reconstruction engineers to calculate more accurately the pre-collision movement and speed of the vehicles. Also, onboard “black box” vehicle computers can provide amazing evidence.
I have acted for many seriously injured motorcyclists. Unlike automobile accidents, severe injuries to arms and legs, including loss of limb, are a common result. Psychological trauma (PTSD) is often also a common symptom as the rider faces what the brain registers as an impending death experience. In all of these cases, we have retained the services of leading medical, psychological and other experts to maximize our client’s claim or award.
As a fellow rider, all motorcycle accidents greatly affect me. My motorcycle accident cases, particularly those with fatalities, are exceptionally challenging. As a lawyer, I must maintain a professional coolheadedness, but as a fellow rider, I must set my “too close to home” emotions aside.
If you or yours have been injured or lost due to a motorcycle accident, please don’t hesitate to email me at dge@einfeldlaw.com, or (250) 712-0001. I’ll gladly give a legal consultation, free of charge.
