The Independent Contractors and Businesses Association of B.C. is celebrating its Supreme Court victory today. Justice Christopher Giaschi has ruled that ICBA and its allies can proceed with its Court challenge of the B.C. Government’s “Building Trades Only Requirement.”
The NDP has imposed a worker’s requirement on all public construction projects. Unless workers are members of an NDP-approved union, they cannot be hired to work on public infrastructure projects. The ICBA says this union-only monopoly is unfair and regressive. The NDP Government sought to keep out the Courts. It pushed to have its Labour Relations Board deal with the issue. Interestingly, the Labour Relations Board is appointed by the Provincial Cabinet.
This matter will not be heard by the Labour Relations Board. It will be heard by the Courts. A victory for British Columbia’s non-union contractors indeed.
