Be careful. As with the population in general, there are liars among us. ICBC adjusters work for ICBC. Their loyalty is to ICBC, not to their insurance claimants. ICBC adjusters who keep their insurance settlements low, and even thwart potential claims, would be doing their job well in the eyes of ICBC. They would be saving ICBC, their employer, money. Unfortunately, some adjusters lie to achieve that result.
We were recently contacted by an accident victim. She had been a passenger in her mother’s car, driven by her sister. Their car was rear-ended, and both sisters were badly hurt. The passenger suffered serious injury to her jaw and teeth, and was facing extensive dental surgery. She turned to ICBC. The adjuster told her ICBC would not cover these costs. Her injuries were a direct result of the accident and the surgery was essential. Yet, her ICBC adjuster denied her the compensation she was entitled to. This only hurt this passenger again. After suffering physical and psychological injuries from the accident, she was now told she’ll be suffering financial hardship. The ICBC adjuster then discouraged her from proceeding with her claim, saying it would hurt her family.
Was this adjuster telling her the truth? No. Unfortunately, this ICBC adjuster was not being truthful.
Here are the facts. The passenger does, indeed, have a claim, as do her sister and mother. They all have a right to sue the negligent driver who rear-ended their car. That driver’s insurance (ICBC), should cover all damages, including injuries to the sisters and to the vehicle. The mother’s insurance will not be affected, since the accident was not her daughter’s fault. The family should not be hurt financially from an accident they did not cause.
