On May 1st, 2021, ICBC launched its No-Fault scheme. Under its new “Enhanced Care,” ICBC deals with negligent drivers as equally as their injured victims . Worse, under British Columbia law, accident victims no longer have the right to sue; neither can they rely on lawyers to advocate on their behalf. In the remote case that the negligent driver is convicted of a criminal offence such as impaired driving, or if your accident occurred out of province, you may, indeed, have a personal injury claim.
